【12港人家屬聲明:立即回應家屬訴求】
12港人被送中至今已 53日,家屬仍未收到絲毫音訊。10月13日,其中一人的家屬委託的律師盧思位獲鹽田公安分局通知,稱被捕者已委託兩名律師,但拒絕向家屬披露律師身份。特首林鄭月娥北上會見國家主席習近平,若林鄭真的視自己為香港人的特首,斷無置 12港人生死安危於不顧之理,為港人發聲,林鄭政府責無旁貸。我們要求林鄭月娥當面向習近平反映 12港人遭受秘密關押之不法待遇,並直接向深圳有關部門施壓,查問並公開 12港人目前的狀況,以及「官派律師」的資料。
中國當局一再以不同藉口,拒絕家屬委託律師面見當事人,如今更強行指派「官派律師」予 12港人,我們至今仍無從得知律師名字,無法查問到 12港人的任何消息。我們相信,香港政府必定有渠道得知 12港人被強迫接受的律師人選,港府務必將此訊息向家屬及社會公開。
12港人被送中秘密關押一案,不僅攸關全香港社會的公眾利益,亦已成為國際曯目的人權事件,中國既以大國自居,以「陽光司法」為傲,何以對 12港人的案件一直左閃右避,不敢向港人及國際交代?目前,國際所見到的,只有中國的不公義與黑獄。
中方應藉此機會向世界展示其「陽光司法」有幾公平公正,而非繼續對被捕港人施以不人道對待,令中國司法體系的聲譽在國際上進一步受創。
12港人家屬要求林鄭向習近平及深圳當局,當面反映訴求,並回應家屬要求如下:
一、公佈12港人的官派律師名單
二、公開雷達記錄,交代警方在事件中的角色
三、香港政府官員現身,直接面對 12港人家屬
香港政府一再以謊言敷衍家屬及公眾、借「司法管轄權」為藉口迴避、推卸責任、12港人的家屬不會放棄追尋真相,及爭取 12港人盡快回港。思及 12港人現時極可能面對的酷刑及不人道的折磨,家屬萬分痛心,但始終為心繫香港、將香港置於自身安危之上的 12港人而驕傲,亦堅信 12港人會在囹圄內繼續堅持,直到重踏故土之日。

[Oct 14: Statement by the families of the 12 Hongkongers: Demand for immediate response]
It has been 53 days since the 12 Hongkongers were sent to China, yet no news has been received by their families so far. On October 13, one of the family-appointed lawyers Lu Siwei, was informed by the Yantian Public Security Bureau that the arrested people had appointed two other lawyers, but they refused to disclose the identity of the lawyers to their families. The Chief Executive Carrie Lam is currently travelling to Shenzhen to meet President Xi Jinping. If Carrie Lam still regards herself as the Chief Executive of the people of Hong Kong, there is no reason for her to turn a blind eye to the life of the 12 Hongkongers and shall speak up for them. We hereby request Carrie Lam to escalate the issue of the illegal incommunicado detention of the 12 Hongkongers to Xi Jingping, and seek for direct pressure on the relevant bureau in Shenzhen to investigate and disclose the current situation of the 12 Hongkongers, as well as the information of the “government-appointed lawyers”.
The Chinese authorities have repeatedly used different excuses to refuse the family-appointed lawyers, and now they have even assigned "government-appointed lawyers" to the 12 Hongkongers. The families have no knowledge of the name of the government-appointed lawyers and thus no update of their family members can be inquired therein. The families believe that the Hong Kong Government must have a channel to find out the names of the lawyers whom the 12 Hongkongers were forced to accept, and the Government must disclose this information to the family members and the public.
The case of the 12 Hongkongers is not only a matter of public interest for Hong Kong as a whole, but has also become the international human rights issue. Given that the Chinese Authorities have always been proud of their "sunshine justice", they shall not shy away from the case of the 12 Hongkongers and refrain from responding to Hong Kong people and the international community.
Instead of continuing to treat the arrested Hongkongers inhumanely and further damaging the reputation of China's judicial system in the international arena, the Chinese authorities should take this opportunity to show the world the fairness and impartiality of their "sunshine justice".
The demands of the 12 families are as follows:
Releasing the list of government lawyers assigned to the 12 Hongkongers;
Release radar records to account for the police's role in the incident; and
Direct meeting with Hong Kong Government Officials.
The Hong Kong Government has persistently lied to the families and public, using "jurisdiction" as an excuse to evade and shirk their responsibilities. The families of the 12 Hongkongers will not give up in finding the truth and will fight for the expeditious return of the 12 Hongkongers. Despite the fact that the families are in great pain that 12 Hongkongers might be facing inhumane torture, they are still proud of the 12 Hongkongers who care about Hong Kong and place Hong Kong above their own safety. They are also convinced that the 12 Hongkongers will continue to persevere behind bars until the day they return to their homeland.

醫護罷工的訴求,正是香港抗疫是否成功之關鍵。政府的默不作為,逼使醫護從前線再走到另一個前線。為何一直叫封關,卻不聞不理?為何私人公司都安排到以廉價賣口罩給普羅大眾,政府卻還想利口罩短缺之事做政治騷?為何差佬打人 OT 去到十億,但病房資源卻嚴重不足?

〖醫護同行 罷工抗疫〗
醫管局員工陣線(下稱本會)第二次特別員工大會於今日順利舉行。是次大會共有會員3164投票,當中3123贊成罷工動議,罷工動議獲得通過。截至現時已有超過9000會員簽署罷工宣言,承諾與我們同行,一同發動為期五日的醫護界罷工。本會理事會在此衷心感謝各位會員的支持。
本會今日走到罷工這一步實屬迫不得已。「緊急應變級別督導委員會暨指揮中心」在特首林鄭月娥的領導之下,一連數日召開記者招待會公布最新的防疫措施。可惜,不論是所謂的「限制」通關、停課停工、醫學監察,抑或盡量調度防疫物資,完全並非對症下藥,最後都必然是於事無補。隨著世界各國政府陸續宣布封關,香港政府卻堅持「門常開」,所有醫療所需、並已於香港出現短缺的物資與人手,終有一日會因源源不絕的外地求診人士而耗盡。種種政府的失策只會令香港的情況越來越嚴峻,甚至達至一發不可收拾的局面。因此,本會絕對不相信在放任懷疑個案經由中國內地進入香港的前提下,任何所謂的防疫措施能發揮效用。
本會在此嚴正要求醫院管理局邀請「緊急應變級別督導委員會暨指揮中心」的主席林鄭月娥,出席本會明日(二月二日)與醫院管理局的談判。本會促請所有當權者可以直接面對前線醫護的質問,並確實回應我們的訴求,而非不斷偷換概念,回避問題。
本會於今日特別員工大會通過的五大訴求如下:
促請醫院管理局就以下兩點向政府發公開聲明施壓:
一· 禁止任何旅客經由中國入境
二· 落實確切方案確保口罩供應充足
促請醫院管理局確保員工工作環境的安全:
三· 提供足夠隔離病房,暫停非緊急服務
四· 提供足夠配套予照顧隔離病人的醫護
五. 公開承諾絕不秋後算賬
本會將會就以上五大訴求落實談判細節,若二月二日談判不能取得正面回應,本會將會發動為期五日的罷工行動。以下為詳細計劃:
【罷工計劃】
罷工計劃為二月三日開始一連五日,共兩階段。
首階段為停止醫管局非緊急服務,在二月三日將採取惡劣天氣下之工作安排,平日於八號熱帶氣旋警告信號生效時無需上班的會員將會參與罷工,包括普通科門診職員及行政人員等;其他部門則按照部門內部就惡劣天氣所作出的當值安排(俗稱颱風更)上班,即假設二月三日已懸掛八號熱帶氣旋警告信號,如當日按照颱風更無需上班的會員則參與罷工。此階段為期一日,若醫院管理局於二月三日 2100 前依然未能就本會五大訴求提出切實解決方案,罷工計劃將立即進入第二階段。
第二階段為動員本會所有會員罷工,即涵蓋所有職系同事,令醫管局只能提供有限度緊急服務。此階段為期四日,若醫院管理局於二月七日前 2359 前繼續漠視本會五大訴求,本會不排除再將行動升級。

Healthcare Workers: Together We Stand, Strike to Protect Hong Kong
The second Extraordinary General Meeting of the Hospital Authority Employees Alliance (HAEA) was held today. There were a total of 3164 votes cast by the members of the HAEA, in which 3123 voted “Yes” to the motion of strike action. As of now, there are more than 9000 HAEA members who have signed the pledge to strike. They have promised to stand with us in participating in the five-day strike plan. The Executive Committee of the HAEA would like to express our sincerest thanks to the tremendous support of our members.
The HAEA believes the decision to strike is not an easy one. In fact, we believe such actions are our last resort. In the past few days, led by our Chief Executive Carrie Lam, the Emergency Response Level Steering Committee cum Command Centre has held multiple press conferences to make announcements on various disease prevention and control measures. Yet, all of these measures (including the reduction on entry to Hong Kong via China, school suspension, medical surveillance, allocation of infection control supplies etc.) are doomed to fail when the government is adamant in refusing to address the crux of the problem. As country after country begins to announce the banning of foreigners’ entry from China, the Hong Kong government chooses to keep its doors wide open. The already limited resources and manpower in Hong Kong that are necessary for healthcare will soon be completely depleted, as an endless stream of non-Hong Kong residents continues to come into the city, seeking for medical care. The already dire situation in Hong Kong could only turn even direr, for the incompetence of our government continues to bring us to the point of no return. Thus, the HAEA refuses to believe that any of the so-called disease prevention and control measures implemented could be truly effective, when there is not a complete restriction of suspected cases entering Hong Kong via mainland China.
The HAEA now urges the Hospital Authority to invite Carrie Lam, the Chairperson of the Emergency Response Level Steering Committee cum Command Centre, to participate in our negotiation meeting with the Hospital Authority tomorrow (2nd February). The HAEA appeals to those in power to listen to the voices of the frontline healthcare workers directly, and to answer our demands in a constructive manner. All actions to mislead or evade the demands should be ceased completely.
The following Five Demands are endorsed in today’s Extraordinary General Meeting -
Regarding the below two points, the HAEA urges the Hospital Authority to issue a public statement to pressure the government into actions –
To forbid all travelers from entering Hong Kong via China
To implement constructive measures to ensure a sufficient supply of masks
Regarding the below three points, the HAEA urges the Hospital Authority to ensure a safe working environment for its staff -
To provide sufficient isolation wards, to stop all non-emergency services
To provide sufficient support and facilitation for healthcare staff caring for patients under isolation
To publicly commit to not taking any disciplinary actions in retaliation
The HAEA will prepare the negotiation details regarding the above Five Demands. If a constructive response cannot be obtained on 2nd February, the HAEA will initiate a five-day strike action. Below is the detailed plan -
Strike Plan
The strike plan will commence on 3rd February for five days in two stages.
The first stage is aiming at suspending the non-emergency services of the Hospital Authority. Existing working arrangement under adverse weather will be adopted on 3rd February. HAEA members who do not need to work under Typhoon Signal No. 8, including staff working in out-patient clinics, administrative staff and so on, will join the strike. For other HAEA members, they will follow the current practice under individual departmental guidelines for adverse weather. The overall arrangement is similar to the situation as if Typhoon Signal No. 8 is hoisted on 3rd February. The duration of the first stage is 1 day, if the Hospital Authority does not propose any concrete solutions to the Five Demands as mentioned by 3rd February at 2100, the strike will be escalated to the second stage.
All members of the HAEA regardless of ranks or specialties will participate in the second stage of strike, aiming that only limited emergency services can be provided under the Hospital Authority. The duration of this stage is 4 days, if the Hospital Authority still does not propose any concrete solutions to the Five Demands by 7th February at 2359, the HAEA will consider to further escalate the degree of industrial action.

1. 近日,警隊的行為就如國際特赦組織所言越見低劣。[1] 這皆因政府漠視其專家提供的建議,並以歇斯底里、毫無章法可言的策略回應持續的動盪。
2. 五個月來,政府持續容許以下情況發生,對警政問題及根本的政治危機藥石亂投:
a. 阻礙救護人員前往現場拯救傷者;[2]
b. 偏頗地處理強姦或酷刑對待被拘留人士的指控;[3]
c. 肆無忌憚地濫用武力;[4]
d. 以諸多藉口為警察的失控或報復行為辯解。[5]
3. 法政匯思強烈譴責警隊濫用武力,及其本末倒置、往往為社區添煩添亂的驅散示威者行動。警方在十一月十一日於香港中文大學(「中大」)、香港理工大學及香港大學等驅散非法集結及/或堵路行為的行動,指稱的事實根據惹人非議。[6] 在撰寫此聲明之時,警方甚至以催淚彈及橡膠子彈回應中大校長的善意,與學生發生激烈衝突,造成最少60人受傷及多人被捕。[7]
4. 歸根究底,現有的制度未能公正地調查涉及警務人員的刑事指控,乃是警民衝突的源頭。樂觀地看,這可能只是個別調查人員的疏忽;悲觀地看,這反映一種互相包庇的文化,可能已由員佐級警員到警務處處長、保安局局長甚至特首,滲透警隊及政府上下。無論是哪一個情況,這種警察橫行無忌的觀感已經令公眾對負責調查大部分罪行的警察的信任蕩然無存。這個缺口一開,刑事司法制度剩下非常有限的能力,處理失職警員。
5. 法政匯思繼續呼籲香港政府成立獨立調查委員會,調查包括六月份以來政府的治安管理手段。除了將肇事者繩之於法外,更重要的是全面檢閱香港警隊以達至結構上的改革。至今,特區政府對於這個明顯又實際的選擇不屑一顧,堅持讓一個缺乏監察權力的獨立監察警方處理投訴委員會(「監警會」)[8] 去調查警察投訴及內部調查科。這正正就是問題根源所在。
6. 監警會委派的國際專家組就這個問題發表《進展報告》。國際專家組與政府持相反意見。他們批評監警會在結構上欠缺全面調查權力,對監警會這一個輕型、監管式的體制是否能夠做出決定性的貢獻表示懷疑,更指出下一步的可能性諸如「委派一個享有所需權力的獨立調查機構以作更深程度及更廣泛的調查」,意味著一個獨立調查委員會。[9]
7. 對於近數星期暴力頻頻,政府沒有採取任何行動,只是堅拒示威者的訴求(包括成立獨立調查委員會),更稱他們為「人民的敵人」。[10] 警員們多月來非人化地濫稱示威者為「曱甴」。[11]
8. 法政匯思絕對不認同法外制裁。此立場於七月二十五日之聲明已表明。然而,當體制構建不能保障市民應有的追索權,暴力兼「私了」必如落山流水跟著來,這已清晰可見。僅說無諾,何能「止暴制亂」?

1. Police conduct has seen, in the words of Amnesty International, ‘another shocking low’ [1] in recent days as the Government ignored constructive feedback by its own experts and hysterically responded to the ongoing unrest without any rational strategy.
2. In particular, these allegations point to a wanton failure on the part of the Government to properly approach policing and the underlying political crisis, now in its 5th month:
a. Obstructing rescuers and ambulances from accessing the injured; [2]
b. Unfair handling of allegations of rape and torture in custody; [3]
c. Unapologetic excesses in its use of force; [4] and
d. Evasive defence of police officers acting impulsively or in retaliation. [5]
3. The Progressive Lawyers Group (the ‘PLG’) vehemently condemns the Police regarding their excessive use of force and dispersal operations which often create the chaos sought to be quelled. On 11 November, the police conducted operations in, amongst others, the Chinese University of Hong Kong (‘CUHK’), the Polytechnic University of Hong Kong and the University of Hong Kong to disperse unlawful assemblies and/or obstruction of traffic, [6] the factual basis of which has been doubted by many. As at the drafting of this Statement, as riot police responded to an olive branch by the CUHK Vice-Chancellor with tear gas and rubber bullets, severe clashes between students and riot police at CUHK are ongoing with at least 60 injured and dozens arrested. [7]
4. Nonetheless, the crux of the problem remains in the institutional failure to investigate criminal allegations involving police officers impartially. At best, it could be an omission by individual police officers in their execution of duty. At worst, it could be a culture that acquiesces and conceals wrongdoings affecting grassroot constables, the Commissioner of Police, the Secretary for Security and the Chief Executive alike. Whichever the case may be, this perception of impunity breaches the trust and confidence the public reposes in the police who are tasked with investigating most offences. With this link broken, there remains very limited recourse in the criminal justice system against rogue officers.
5. The PLG continues to call on the Hong Kong Government to appoint a Commission of Inquiry regarding, amongst others, the current approach to policing social unrest since June. Bringing wrongdoers to justice aside, the more important task is a holistic review on the Police Force and a roadmap to structural reforms. So far, the Government brushed aside this obvious and pragmatic option, insisting upon an inquiry by the Independent Police Complaints Council (‘IPCC’) [8] whose (lack of) oversight over the Complaints Against Police Office (‘CAPO’) is the very issue at the heart of the current saga.
6. Curiously, the International Expert Panel of the IPCC appointed for advice on that very inquiry seems to hold a contrary view. In their Position Statement Report of Progress, the experts pointed out ‘structural limitations in the scope and powers of the IPCC Inquiry’ and noted that ‘it remains to be seen whether a light touch, oversight body like the IPCC, can make sufficient progress to produce any decisive contribution…’ It also identified a possible next step such as ‘a deeper more comprehensive inquiry in a number of respects by an independent body with requisite powers’, alluding to a Commission of Inquiry. [9]
7. In response to the extraordinary brutalities these few weeks, the Government did nothing but maintain that it will not yield to the protesters’ demands (including an independent Commission of Inquiry) and call them ‘enemies of the people’. [10] It has not helped that the police have for months been blatantly using such a dehumanising term as ‘cockroaches’ to refer to protesters [11].
8. The PLG stands by our Statement on 25 July 2019 and does not encourage citizens to take justice into their own hands. However, it is obvious by now that where the system fails to provide proper recourse, vigilantism and violence proclaiming self-defence arise as simple cause and effect. Without any real commitment by the Government to de-escalate and defuse the political crisis, verbal condemnation and physical crackdown will do nothing to ‘stop violence and curb disorder’.
