[A quick overview on choice of legal entities for international founders setting up in Taiwan, part 1]

Hi, I’m Norman, an AppWorks Analyst. As an analyst here, one common question I’ve been hearing from international founders is: what type of business entities should I register for when I am trying to set up in Taiwan? And what are the differences among all the options?

Usually, international founders will approach local accounting firms for help, but it can be costly, usually around US$ 200~1,500, and still requires you to digest a lot of information before a decision can be made. My next two posts will be dedicated to giving international founders a quick overview on what options you have at your disposal and the key considerations to keep in mind. Hopefully after finishing reading these 2 posts, you will have a clearer understanding of what type of business entities you can set up in Taiwan. Let’s get started!

So far there are generally three ways to set up an entity in Taiwan:
1. Set up a representative office
2. Set up a local company
3. Set up a branch office

When founders are thinking about what type of entity to set up, the first thing you must consider is whether you are going to conduct business in Taiwan (meaning whether or not you are going to sell products or provide services in Taiwan.)

For founders who already set up an entity outside of Taiwan, you might want to find business partners, display your products, or appoint someone to represent the company in a legal capacity in Taiwan. If you are not planning to conduct business activities, then you can consider setting up a representative office. The procedure for setting up a representative office is the easiest one, as it just takes two weeks to one month. There is no need to file a capital verification report and proceed with business registration. Founders just need to file the registration application with the Ministry of Economic Affairs authority.

However, the representative office comes with its own limitations. As this type of entity is not allowed to conduct “any” business activities, which means you will not be able to complete any transactions and issue invoices. In addition, you can’t turn representative offices into another type of entity. As a result, if you set up a representative office successfully in Taiwan first, and then figure out that you should do business directly in Taiwan, you have to file another application to set up a new entity and also apply for nullification of the representative office registration.

BACA QURAN PADA TELEFON

SOALAN :

Pada zaman sekarang segala macam benda ada di dalam internet dan telefon bimbit termasuk Al-Quran.

Soalan saya adakah dapat pahala membaca Quran dengan melihat melalui skrin computer atau skrin telefon bimbit?

JAWAPAN :

Membaca Quran samada dengan menggunakan mushaf atau pada zaman sekarang melihat pada skrin computer atau skrin telefon bimbit adalah mendapat ganjaran pahala.

Begitu juga membaca dengan melihat ayat Quran yang diletakkan pada dinding-dinding rumah atau banggunan atau yang dicetak pada kertas atau seumpamanya adalah mendapat pahala.

Telah diriwayatkan daripada Aisyah r.a. Rasulullah saw bersabda :

وَالنَّظَرُ إلَى الْكَعْبَةِ عِبَادَةٌ، وَالنَّظَرُ فِي وَجْهِ الْوَالِدَيْنِ عِبَادَةٌ، وَالنَّظَرُ فِي الْمُصْحَفِ عِبَادَةٌ

Artinya : “Dan melihat kepada Ka’bah itu ibadah dan melihat kepada dua ibu bapa itu ibadah dan melihat kepada mushaf itu ibadah.” (Hadith Abu Daud)

Dan diriwayatkan daripada Al-Auza’ie beliau berkata :

كان يعجبهم النظر في المصحف بعد القراءة هيبة

Artinya : “Adalah yang menakjubkan manusia ialah melihat kepada mushaf selepas dari selesai membacanya.”

Dan berkata Imam ‘Alauddin Al-Kasani :

النظر في المصحف عبادة، والقراءة عبادة

Artinya : “Bermula memandang kepada mushaf itu ibadah dan membaca itu ibadah.” (Kitab Badai’u Sona’iq)

Oleh itu dapat dibuat kesimpulan bahawa membaca Quran dari skrin computer atau skrin telefon bimbit sebagaimana datang dalam soalan tetap mendapat pahala yaitu pahala mata melihat kepada ayat Quran dan lidah menyebutnya.

Dan jika membaca dari mushaf yang mempunyai helaian maka ditambah satu lagi kelebihan pahala yaitu jari tangan yang membelek helaian muka surat Quran yang dibaca itu.

Telah berkata Mufti Mesir Dr Syauqi ‘Allam :

تحصيل الثواب بالنظر إلى آيات القرآن في الشاشات الإلكترونية وتلاوتها مثله مثل المصحف الشريف من حيث تحصيل الثواب بقراءة كل حرف من حروف القرآن الكريم، وإن كانت القراءة في المصحف الورقي عبادة يزيد ثوابها عن مجرد القراءة؛ وذلك لاشتراك حواس أخرى غير اللسان؛ حيث تشترك العين بالنظر إلى عين المصحف، وتشترك حاسة اللمس بمس أوراقه

Artinya : “Menghasilkan pahala dengan memandang kepada ayat-ayat Quran pada skrin elektronik dan membacanya samalah seperti membaca mushaf yang mulia dari sekira-kira mendapat pahala dengan membaca satu huruf dari segala huruf Quran yang mulia. Dan jika adalah bacaan itu pada mushaf yang mempunyai helaian ialah ibadah yang lebih pahalanya dari semata-mata membaca. Yang demikian itu adalah kerana turut serta pancaindera yang selain dari lidah sekira-kira berkongsilah mata dengan melihat kepada mushaf dan tangan pula membelek helaiannya.” (Darul Ifta Mesir)

READ THE QURAN ON THE PHONE

QUESTION:

Nowadays all sorts of things are on the internet and cell phones including the Quran.

My question is can I reward Quran reading by looking through computer screen or cell phone screen?

ANSWER:

Reading Quran whether using mushaf or nowadays looking at computer screen or cell phone screen is rewarded.

So also read by seeing Quran verses put on the walls of the house or building or printed on paper or such is rewarded.

It has been narrated from Aisyah r.a. Rasulullah saw said:

Looking at the Kaaba is a cult, looking at the face of parents is a cult, and considering the Quran is a cult

Meaning: ′′ And looking at Ka ' bah is worship and looking at two parents is worshiping and looking at mushaf is worship." (Hadith Abu Daud)

And narrated from Al-Auza ' ie he said:

They liked looking at the Quran after reading prestige

Meaning: ′′ The amazing human being is looking at mushaf after finishing reading it."

And said Imam ' Alauddin Al-Kasani:

Considering the Quran is worship, reading is worship

Meaning: ′′ Starting to look at the mushaf is worship and reading it's worship." (Book of Storm ' u Sona ' iq)

Therefore it can be concluded that reading Quran from computer screen or cell phone screen as it comes to question still gets reward that is the reward of the eyes look at the Quran verse and the tongue calls it.

And if reading from mushaf has a sheet, then there is another reward of the finger that turns the page of the Quran.

Has said Egyptian Mufti Dr Syauqi ' Allam:

Collecting the reward considering the verses of the Qur ' an in electronic screens and reciting them like the Holy Quran in terms of collecting the reward by reading each letter of the Holy Quran, although reading in the paper Quran is a worship more than just reading; to subscribe other senses other than The tongue; where the eye participates in looking at the eye of the Quran, and the sense of touching shares its leaves

Meaning: ′′ Earn a reward by looking at the Quran verses on an electronic screen and read it as well as reading the noble mushaf from about getting a reward by reading one letter of all the holy Quran. And if it is the reading of the mushaf who has a sheet is a worship that is more rewarded than just reading. That is because of the part of the tongue that is apart from the tongue, about sharing the eyes by looking at the mushaf and the hands turn his sheet." (Darul Ifta Egypt)
