該案forwarder只有給我Cargo receipt 我沒有拿到B/L 且已送押匯
難道forwarder自己偷偷開了B/L給客人提貨??
同依個客人還有另一合約也是簽這樣 想說先看看有沒有什麼方式操作比較好

你的CASE應該也是三角貿易吧...
因為三角貿易很多SUPPLIER(生產商) 不是SHIPPER(押匯的人)，
提單有很多連，提單在海運過程/尚未提貨完成，是提貨權的唯一憑據
提單上的SHIPPER就是有貨權的人。
三角貿易，通常都是SUPPLIER傳託書給FORWARDER，
本來貨權自然在SUPPLIER手上，如果你沒有特別傳提單作法給FORWARDER
SHIPPER會寫傳託書的SUPPLIER，
此時SUPPLIER要寫貨權轉讓切結書給FORWARDER通知貨權現在轉給押匯的人
(SHIPPER的地方打"SHIPPER"，這裡指押匯的人)，
另外SUPPLIER付完LOCAL CHARGE，FORWARDER就沒有理由扣住提單
<正常三角貿易流程>
生產者------->你/押匯的人 ======>客人/贖單的人
生產者寫切結書把貨權放給你，你押匯，客人贖單/付錢到提單也拿到貨權。

*L/C下的提單作法
SHIPPER: 你
CONSIGNEE:通常是開狀行 (一定要是銀行!!)
NOTIFY:才是客人
因為L/C是透過銀行保障的交易，提單上面的CONSIGNEE作銀行，
然後你送押，你的銀行把正本提單寄給CONSIGNEE銀行
CONSIGNEE銀行現在表面上是有貨權的人，也有提貨依據
銀行該做的事情: 通知客人來贖單。(客人付錢給銀行，銀行再給你錢)
只要不是亂七八糟的銀行，都不會私下就放單給客人，
因為如果客人不贖單，還有正本提單可以領貨，
銀行完全站不住腳等挨告吧!!
信用狀就是你比較相信銀行，甚於相信客人
銀行替你做 一手交錢一手交貨(提單)的工作，然後收取服務費。

信用狀的精神是條件付款，你達到條件/沒有瑕疵，客人就該贖單
(基本上，只要客人要貨，就算瑕疵也要贖單!!)
(而且，要完全沒有瑕疵幾乎是不太可能的)
提單的做法一定要向上面這樣貨權才安全，照正常流程
所以你的客人開狀來的時候，你可以要求他修改信用狀
如果他不願意改，我還是會照上面的流程來做提單，
海運提單在沒有收到錢/贖單之前絕對不放
這樣押匯會有瑕疵，是的，但是了不起多80元的費用，又如何?
客人只要要貨，就算是瑕疵他也得贖單才能拿到提單領貨。
如果客人不要貨，不贖單，至少貨還在你手上。

押匯拿得到錢的前提是，客人要贖單，銀行才會付你錢。
有些遠期的信用狀，客人已經承兌，你們公司就可以去跟銀行貼現。
在客人還沒有贖單(即期:付款/遠期:承兌)前，銀行是不願意貼現
如果他們願意貼現給你，那是銀行自己承擔風險先墊支給你
根據你過去的信用，這就是為什麼有些公司有信用狀就貼現來用。
