米迦 Micah：緊急狀態有乜用？


喺較早嘅時候，美國總統 Donald J. Trump 正式宣佈美國全國因為武漢肺炎而進入緊急狀態，以便聯邦政府可以進行下一步嘅防疫措施同計劃。因為呢個緊急狀態係以Stafford Act為基礎嚟做，因此佢哋就可以調動超過500億美金嚟應付呢場災難，大多都會用嚟資助又或者支援唔同受影響嘅地方政府、城市同埋人民。雖然侵侵重宣布咗好多救災措施，呢啲唔同新聞紙都有講嫁喇，所以今次我哋就先唔講呢樣嘢住，我哋就不如襯呢個機會嚟了解一下喺美國嘅「緊急狀態」又係乜嘢玩法啦。


美國總統擁有宣布全國進入緊急狀態嘅權力呢樣嘢，係源自於1976年國會所通過嘅 The National Emergencies Act。呢份法案授權美國總統可以喺佢認為有需要嘅時候，可以動用呢份法案所賦予嘅權力嚟宣布美國進入緊急狀態。雖然字面上聽落好似好緊急，但實際上喺立咗呢條法案嘅呢四十幾年之間，美國大大話話已經宣布咗六十次進入緊急狀態，而至少有三十個緊急狀態令到依家依然有效，因此你係咪會立即覺得呢個「緊急狀態」睇落都好似唔係好「緊急」呢？


無錯，「國家緊急狀態」呢樣嘢對美國嚟講都可以話係家常便飯，基本上自立法以嚟每任總統一年都會玩一兩次，原因就係因為美國總統可以藉宣布「國家緊急狀態」嚟得到特權。喺正常情況之下，美國總統有一項權力，就係佢可以向聯邦政府嘅行政部門下指命令叫佢哋照住總統嘅意思做嘢，而呢項權力就係Executive order，姐係我哋成日都聽到嘅「行政命令」。不過「行政命令」本身有個限制，就係當國會通過嘅法案同「行政命令」有所衝突果陣，「行政命令」就會受到限制。雖然以上政制完美體現咗權力制衡呢樣嘢，但問題在於呢樣嘢係有一個缺點，就係一個凡係民主國家都會出現嘅問題。


喺民主國家入面，如果喺國家面臨一啲切身嘅危機果陣，國會果啲本來就係刻意哂時間哂精神嘅立法程序就會變得十分之無意義，咁作為民主先驅嘅美國少不免都會有呢啲問題，因此喺呢個時候「國家緊急狀態」呢樣嘢就派上用場喇。


當美國總統宣布國家進入「緊急狀態」之後，喺 The National Emergencies Act 嘅授權之下，喺危急情況下總統可以行使136種緊急權力。雖然其中有13種係必須要得到國會授權先可以動用之外，另外果123種權力基本上不受限制。就係咁，美國總統就可以有權凌駕國會原先立咗嘅法案，立一條專項法案又得，又或者就好似今次咁，喺國庫入面挪用預算又得。不過呢個狀態都唔係大哂嘅，如果總統無自行解除緊急狀態嘅話，佢就要每年向國會報告相關緊急狀態嘅進度，等個緊急狀態可以繼續延長落去。而如果國會有超過三份之二嘅人反對嘅話就可以立即中止總統宣佈嘅「緊急狀態」。無錯，民主制度就係咁麻煩，而就係因為佢夠麻煩，先可以做到權力制衡。


咁喺了解過美國嘅「國家緊急狀態」之後，如果對美國政治有些少了解嘅朋友就會問，呢次嘅「國家緊急狀態」同之前侵侵要喺美墨邊境起圍牆嘅果一個係咪一樣嫁？咁就當然唔係啦，原因就好似我一開始講嘅咁，呢次嘅緊急狀態係以Stafford Act為基礎嚟做，所以就有啲分別喇。咁咩叫Stafford Act呢？


Stafford Act，全名叫做The Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988，係授權美國聯邦緊急事務管理署 the Federal Emergency Management Agency (FEMA) 去指揮美國聯邦政府應對災害，同時亦都喺天災人禍上面支援州政府同唔同嘅地方政府。其實Stafford Act自通過以嚟就用過好多次嫁喇，喺遭受恐怖襲擊例如911同埋2011年波士頓馬拉松恐襲果陣有用過，亦都係天災例如颶風卡特里娜吹襲美國果陣用過，不過喺公眾衛生危機上就無乜點用過喇。而當Stafford Act 被啟動咗之後，美國聯邦政府就可以對受災嘅人民進行即時嘅直接援助，例如可以直接提供免費緊急醫療救護服務俾受災人民，起一啲臨時醫院去紓緩醫院床位不足嘅問題之類，亦都可以向人民提供糧食、食水、藥物等等嘅支援，簡單啲嚟講就係國家隊級別嘅人道支援服務。


聽落係咪好唔錯呢？咁當然啦，民選政府自然要對自己嘅人民負責，係好正常不過嘅事。至於果啲咩復辟帝制嘅國家又或者某一賤婦控制嘅無能政府就當然做唔到啦，因為佢哋都唔使對自己嘅人民負責嘅，咁自然係理得你死啦。想問點解佢哋會咁無良心？你會唔會知自己食過幾多塊麵包啊？倒不如問下自己點解咁忍得好過啦。不過我都係唔阻大家繼續搶口罩搶廁紙之餘，繼續維持社會安定繁榮穩定，Bye！

生肖屬猴、虎、豬、蛇者，請向妳你自己的師父（若有的話），請示要如何安奉當年太歲星君，以保流年身心、身體健康、事業順心、家庭合樂、道心堅固、智慧增長、投資安穩、大事化小、小事化無等等。一般人都不會及較少，在家中安奉當年太歲星君。因此，可到有供奉六十位太歲星君的廟宇拜太歲及點光明燈。禮拜太歲星君時，除了獻上供品、蠟燭紙金以外，千萬要記得虔心稱呼，值年的太歲星君啊！歲次丙申太歲星君叫管仲，在拜太歲時，妳你就虔心稱呼祂為「丙申年管仲太歲星君」，這樣妳你才真真正正，拜到那一位值年的太歲星君。

徐天佑及陳奐仁首支合作新歌《Fart》，電子曲風加上Rap的元素都是二人喜歡的音樂風格。今次《Fart》一曲，徐天佑由主唱退居幕後成為監製，更參與編曲、作曲部份，亦充當MV導演；資深監製陳奐仁負責曲詞編監之餘，更擔起主唱部份，完美演繹一這首玩味十足的電子歌曲，二人身份互換，迸發出不少火花。

因為一次電影合作中飾演情侶，陳奐仁、徐天佑二人一拍即合，更發現彼此皆喜歡EDM音樂，Hanjin聽完天佑創作的Beats，非常喜歡，所以促成今次合作，交流創作心得。

二人將肚痛、放屁難忍的真實一刻放進歌詞，剛好「放屁」一詞在國語的意思，也在諷刺一胡說八道、言詞誇張的人，經常「吹水」來包裝一切，所以用開玩笑的方式來比喻有話應該直說。
